Terms of Service

Welcome to VibeKOL. By downloading, installing, or using our application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.

1. Acceptance of Terms

By accessing or using VibeKOL, you confirm that you are at least 13 years old and have the legal capacity to enter into these Terms. If you are using the App on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Account Registration

  • You must sign in with a valid Google account to use the App
  • You are responsible for maintaining the security of your account
  • You must provide accurate and complete information
  • One account per person; account sharing is not permitted

3. Credits & Subscriptions

3.1 Credit System

  • The App uses a credit-based system for AI generation features
  • Free accounts receive 3 credits per month
  • Credits from subscription plans reset at the start of each billing cycle and do not carry over
  • Purchased credit packs (top-ups) do not expire

3.2 Subscriptions

  • Subscriptions are billed monthly through Apple App Store or Google Play Store
  • Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period
  • You can manage or cancel subscriptions through your device's store settings
  • No refunds for partial months or unused credits within a billing cycle

3.3 Pricing

We reserve the right to change pricing at any time. Price changes for existing subscribers will take effect at the next renewal date with prior notice.

4. Acceptable Use

You agree NOT to use the App to:

  • Generate content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable
  • Create deepfakes or misleading content intended to deceive others
  • Generate explicit, pornographic, or sexually suggestive content
  • Impersonate real individuals without their consent
  • Violate any intellectual property rights of third parties
  • Attempt to bypass, disable, or circumvent any security features or usage limits
  • Use automated means (bots, scrapers) to access the App
  • Reverse-engineer, decompile, or disassemble the App

5. AI-Generated Content

5.1 Content Ownership

  • You retain ownership of the photos you upload to the App
  • AI-generated images and videos created through the App are licensed to you for personal and commercial use
  • You are responsible for ensuring your use of generated content complies with applicable laws

5.2 Content Limitations

  • AI generation results may vary and are not guaranteed to meet specific expectations
  • Content may be filtered or blocked by AI safety systems
  • We reserve the right to refuse generation of content that violates our policies
  • Credits used for failed or filtered generations may be refunded at our discretion

5.3 No Warranty on AI Output

AI-generated content is provided "as is." We make no guarantees about the accuracy, quality, or suitability of generated content for any particular purpose.

6. KOL Management

  • KOL profiles you create are stored locally on your device and optionally synced to your Google Drive
  • You are responsible for backing up your KOL data
  • We are not liable for data loss resulting from device failure, app uninstallation, or Google Drive issues

7. Cloud Sync

  • Cloud Sync uses your personal Google Drive storage
  • Enabling Cloud Sync requires granting Google Drive access permissions
  • We do not access, read, or modify any Google Drive files outside of the App's designated sync folder
  • You can disable Cloud Sync at any time

8. Intellectual Property

The App, including its design, features, code, branding, and documentation, is owned by VibeKOL and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works of the App.

9. Disclaimers

  • The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind
  • We do not guarantee uninterrupted or error-free service
  • AI generation depends on third-party services (Google Gemini) which may experience downtime
  • We are not responsible for content you create or how you use generated content

10. Limitation of Liability

To the maximum extent permitted by law, VibeKOL shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the App.

Our total liability for any claim shall not exceed the amount you paid to us in the 12 months preceding the claim.

11. Termination

  • You may stop using the App at any time by uninstalling it
  • We may suspend or terminate your account if you violate these Terms
  • Upon termination, your right to use the App ceases immediately
  • Provisions that by nature should survive termination will survive (including limitations of liability)

12. Changes to Terms

We may modify these Terms at any time. We will provide notice of material changes through the App. Continued use of the App after changes constitutes acceptance of the modified Terms.

13. Governing Law

These Terms are governed by the laws of Vietnam. Any disputes shall be resolved in the courts of Ho Chi Minh City, Vietnam.
